Acceptance of Terms

By accessing or using Banananano AI, including the guest trial, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. You must be legally able to enter this agreement and meet the minimum age required where you live.

Description of Service

We provide an independent browser interface for AI image generation and editing through third-party model and infrastructure providers. Model names belong to their respective owners. Banananano AI is not affiliated with or endorsed by Google, Black Forest Labs, OpenAI, ByteDance, or other model providers.

Models, providers, parameters, prices, limits, and availability can change. Generation is probabilistic: we do not guarantee a particular output, exact text, identity consistency, completion time, resolution, provider uptime, or continued availability of any model. A model shown in a historical article is not necessarily available in the generator.

User Accounts

You are responsible for accurate account information, credential security, and activity under your account. Notify support@bananananoai.com of suspected unauthorized use. Guest trials are limited per visitor and network; you may not evade limits by clearing identifiers, automating new identities, or otherwise bypassing access controls.

Inputs, Outputs, and AI Providers

You keep any rights you already hold in prompts and reference images. You grant us a limited license to host, transmit, reproduce, and process those inputs only as needed to operate, secure, and support the service. Generation content is sent to the provider selected for the model, which may include Kie.ai, fal, Google Gemini, or Replicate. Their terms and policies also apply to their processing.

Subject to applicable law and third-party rights, you may download and use outputs produced for you. However:

• We do not assign or guarantee copyright, trademark, publicity, privacy, likeness, or other rights in an output.
• Similar or identical output may be generated for other users.
• You must own or license your inputs and review outputs before publication or commercial use.
• Model-provider terms, plan restrictions, and applicable law may impose additional conditions.
• We add no visible overlay watermark to downloads, but providers may embed SynthID, metadata, or other provenance signals. You may not remove or misuse provenance information where prohibited.

Do not treat an output as legal, medical, financial, safety-critical, or factual advice. Generated people, brands, text, and events may be inaccurate or fabricated.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Infringe intellectual property, privacy, publicity, biometric, confidentiality, or other rights.
• Upload content you do not have permission to use.
• Generate or distribute sexual abuse material, non-consensual intimate imagery, exploitative content involving minors, unlawful impersonation, fraud, malware, or instructions that facilitate serious harm.
• Attempt to gain unauthorized access to our systems or data.
• Interfere with service integrity, scrape protected areas, evade quotas, probe for secrets, or burden the service through abusive automation.
• Misrepresent AI-generated content as authentic evidence or use it to deceive, harass, discriminate, or violate a provider's acceptable-use policy.

We may block a prompt, model, task, account, or network when reasonably necessary to enforce these rules or protect the service.

Payment and Billing

Guest and promotional access is limited and may change. Signed-in generation spends credits based on the model, resolution, and image count shown before submission. Credits are a service-use unit, not money, a bank account, or an investment; they are non-transferable except where we expressly allow it.

Paid features are billed as shown at checkout. Taxes, renewal terms, and the selected payment processor's terms may apply. Provider or queue failures are handled according to the service logic and current Refund Policy; refunds are not automatic merely because an output is subjective or does not match your preference. Nothing in these Terms limits non-waivable consumer rights.

Intellectual Property

The service's original code, interface, brand assets, and site content are owned by us or our licensors. These Terms do not grant you rights to our trademarks or to third-party model names and marks. Your ownership claims in inputs and outputs are addressed above.

Storage and Privacy

Generation requests may be processed and retained by third-party providers, and signed-in task history or output URLs may be stored by the service. Do not submit secrets or highly sensitive personal data. See the Privacy Policy for provider categories, guest identifiers, analytics, retention, and data-rights requests.

Termination

You may stop using the service and request account deletion by emailing support@bananananoai.com. We may restrict or terminate access for a Terms violation, fraud, security risk, legal requirement, non-payment, or conduct that threatens users or the service. Provisions that by nature should survive termination—including payment obligations, rights, disclaimers, and liability limits—continue to apply.

Limitation of Liability

The service and generated outputs are provided on an "as is" and "as available" basis to the extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and output accuracy where legally permitted.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, third-party provider actions, or claims arising from your inputs, outputs, publication, or inability to use the service. Nothing here excludes liability that cannot legally be excluded.

Changes to These Terms

We may update these Terms as the product, providers, or law changes. We will revise the date above and provide additional notice when reasonably required for a material change. Continued use after the effective date means you accept the updated Terms, except where law requires another form of consent.
